Terms of Use

This agreement defines the terms and conditions to which you are subject and must agree in order to use the services and view the content associated with Online-Shop.com.my. You understand that you agree and pledge to uphold this Agreement when you visit, access, register with, or otherwise use Online-Shop.com.my website and associated services. If you do not wish to be bound by this Agreement, please do not use, access, or view the site.

You also understand and agree to abide by the terms and conditions described in The Online-Shop.com.my Privacy Policy in conjunction with this User Agreement.

1. Eligibility.

All services offered by Online-Shop.com.my are available to persons able to enter into legally binding contracts as per existing applicable laws. Therefore, minors under the age of 18 may not use or access Online-Shop.com.my services without the direct supervision and/or participation of their legal parent or guardian. Online-Shop.com.my reserves the right to terminate, refuse, or otherwise limit the eligibility of any current, future, or potential member at any time, with or without reason. By becoming a member of Online-Shop.com.my, you understand and accept that all information relating to your membership, including handle, email, and site materials will not be sold, rented, or otherwise distributed to any third part at any time.

2. Fees and Services.

By accepting this Agreement, you signify that you understand and accept all subscription and service fees and agree to be held responsible for any fees or site-related activities associated with your unique handle and password, assigned to you upon registration. Failure to pay any fees incurred as a result of your use of the site will result in termination at Online-Shop.com.my discretion with no refund. All fees and services are subject to change with or without notice. All fees are listed in U.S. Dollars unless specifically noted otherwise.

You may terminate your membership of the site at any time via written communication only. You understand and agree that all fees incurred up to and including the day Online-Shop.com.my receives your notice of termination are your sole responsibility. No subscription fees will be refundable, regardless of when the membership termination notice is received. Some types of fees other than subscription may be refundable upon termination at Online-Shop.com.my sole discretion.

3. Commercial Use of The Online-Shop.com.my Site.

Online-Shop.com.my site and related services are for the express use of The Online-Shop.com.my members. Non-members may not access member-restricted portions of the site for any reason. As a member, you agree to not provide access to any non-member for any reason. No commercial entity nor any individual associated with a commercial entity may use The Online-Shop.com.my site, except as a sponsor and/or advertiser using the proper procedure. Any member using services provided by Online-Shop.com.my to advertise, promote, or otherwise spam other members will be terminated immediately without refund. As a member you pledge to forgo the commercial promotion of any entity with which you are associated while using Online-Shop.com.my services and/or accessing the site.

4. Content Copyrights.

All Online-Shop.com-related content, logos, trademarks, and procedures are the copyrighted property of Online-Shop.com.my. You understand and agree that the reproduction, copying, transmission, distribution, or display of said materials is illegal and will result in the immediate termination of your membership without refund and prosecution of you under applicable laws.

Any unique, original works or materials created solely by you and submitted by you in the registration process are your property. By becoming a member, you grant permission to Online-Shop.com.my to reproduce said works and/or materials within the domain of The Online-Shop.com.my site and related Online-Shop.com.my promotional materials or publications. Online-Shop.com.my will never sell or reproduce your work without your written consent outside of the above stated permission.

5. Online-Shop.com.my is a Venue.

Online-Shop.com.my site is a venue for the transaction of unique, original product by the owner. Online-Shop.com.my is not involved with the actual transaction between a buyer and a seller. Therefore, Online-Shop.com.my is not responsible nor does Online-Shop.com.my vouch for the accuracy, quality, safety, or legality of items listed within the site. Nor does Online-Shop.com.my guarantee the ability of a buyer to pay for an item or the ability of a seller to sell an item. Thus in no way does Online-Shop.com.my transfer the legal ownership of any item between a buyer and a seller. As a member, you understand and agree that all transactions you may initiate or carry out are your sole responsibility. Additionally, as a seller you agree to the automatic assessment of a commission fee for every item you sell, and you accept that any commission refunds in the event of a failed sale will be issued at Online-Shop.com.my's sole discretion.

By accepting this Agreement, you signify that you understand that a buyer and/or seller with whom you engage in a transaction through the site may provide you with false, misleading, fraudulent, or otherwise inaccurate information, and you agree to release Online-Shop.com.my of any responsibility for any damages, negligence, or any other negative effects resulting from your dealings and/or transactions with other site members. Additionally, you agree to release Online-Shop.com.my from any responsibility for any claims, damages, and demands resulting from disputes arising from your interaction and/or dealings with other site members.

You also understand and accept that while Online-Shop.com.my will make a good faith effort to control and/or monitor inappropriate, inaccurate, illegal, offensive, obscene, or other unacceptable content, you may encounter said content while using Online-Shop.com.my site. You agree to release Online-Shop.com.my from any responsibility for such content encountered by you while using Online-Shop.com.my's site or services. You also release Online-Shop.com.my from any responsibility for any subsequent interaction and/or communication with other site members, while using Online-Shop.com.my site or services or outside of said site or services.

Persons using Online-Shop.com.my to purchase product understand and accept that by completing the purchasing process, they are obligated to purchase said item(s) and to be bound by the conditions of the sale as stated during the purchase process, except where the sale of said item violates this agreement or any applicable laws. This obligation may be waived under extraordinary circumstances at the sole discretion of Online-Shop.com.my. Violation of this obligation may result in membership termination without refund and/or a publicly viewable negative rating within the site at Online-Shop.com.my's sole discretion, and possible prosecution under any applicable laws.

Persons using Online-Shop.com.my to sell product certify that each item is a unique, original work created by them and that they own said item both materially and intellectually. Sellers understand and accept their obligation to provide a purchased item to the buyer. All sellers pledge to make a good faith effort to provide purchased items within a reasonable time frame from the purchase date. As a seller you understand and accept that failure to fulfill said obligation may result in the termination of your membership without refund and/or a publicly viewable negative rating within the site at Online-Shop.com.my's sole discretion, and possible prosecution under any applicable laws.

6. Content Posted by Members

Online-Shop.com.my claims immunity from liability of any kind resulting from site content posted, created, or communicated by members using site services or features. You understand and agree that Online-Shop.com.my may delete and/or remove any content posted, created, or communicated by you at any time, with or without reason.

You also accept that any content you post, create, or communicate using Online-Shop.com.my's site or services you are solely responsible for. Additionally, you pledge to never post or communicate content that may be deemed offensive, obscene, inaccurate, or illegal. You also pledge to never post or communicate content that is in violation of others' copyright, trademark, intellectual property, or "fair use" rights. Any violation of said pledges may result in the termination of your membership without refund at Online-Shop.com.my's sole discretion and/or prosecution under any applicable laws.

If you believe that content posted or communicated by Online-Shop.com.my members violates your copyright, trademark, intellectual property, or "fair use" rights, please file a complaint with Online-Shop.com.my. Please include an image or copy of the item in question, proof of your right to ownership, a detailed description of said item, and a specific place on The Online-Shop.com.my site where the item may be found. Online-Shop.com.my will take action as it deems appropriate.

By accepting this Agreement you understand and pledge that you will use Online-Shop.com.my site and services in a manner consistent with any and all laws and regulations.

7. Interference.

You pledge to never employ any type of robot, spider, scraper, or other automated method to access and/or view The Online-Shop.com.my site. You also pledge to never employ viruses, worms, cancel bots, or any other type of damaging code or software while using The Online-Shop.com.my site.

You also pledge to never engage in any activity that may result in the overload, breakdown, vandalism, or destruction of Online-Shop.com.my site infrastructure or workings. You understand and agree that any such action, determined at Online-Shop.com.my's sole discretion, will result in the immediate termination of your membership without refund and possible prosecution under any applicable laws.

8. Feedback.

By accepting this Agreement you acknowledge that you have read and understand The Online-Shop.com.my Feedback Rating System and agree to be subject to any rating you may receive as a result of your activities and/or behavior while using the site. You also understand and agree that member ratings are controlled and monitored by Online-Shop.com.my and any membership termination resulting from member rating is final and non-refundable. You also pledge to never market, export, or otherwise share your Online-Shop.com.my member rating with any third party or venue outside of The Online-Shop.com.my community.

9. Breach.

You understand and agree that any activity taken by you while using Online-Shop.com.my's site or services that is deemed in violation of this Agreement by Online-Shop.com.my may result in membership suspension or termination without refund or other limitations to your use and/or access to the site.

10. Warranty.

Online-Shop.com.my and all related entities offer all services and products as is, and do not provide any warranty of any kind for the use of any service or product associated with Online-Shop.com.my. By accepting this Agreement, you acknowledge that you cannot claim any warranty of any kind for any product, item, or service purchased or used in relation to The Online-Shop.com.my site.

11. Liability Limitation.

By accepting this Agreement you agree to release any and all liability from Online-Shop.com.my arising from any damages, lost income or profits, lost or stolen material, or any other loss resulting from the use of the site or any subsequent action taken by you in relation to the site.

12. Indemnity.

By accepting this Agreement, you agree to indemnify and hold Online-Shop.com.my materially and physically harmless from any claim or litigation made by any third party against you and arising from your use of Online-Shop.com.my's site or services, your breach of this Agreement, or any violation by you of any applicable laws.

13. Disputes and Resolution.

Disputes arising between you and Online-Shop.com.my not addressed by the terms and conditions of this Agreement may be resolved by: (a) making a reasonable request directly to Online-Shop.com.my to redress grievances, in which case Online-Shop.com.my will make a good faith effort to examine the request and grievance and provide a reasonable solution. This option will be entertained by Online-Shop.com.my solely at its discretion.

14. Amendments.

The terms and conditions of this Agreement may change or be amended at any time with or without notice. In case of amendment, change, or alteration, you agree to be bound by the new Agreement and all of its provisions, regardless of whether you were aware of any changes, amendments, or alterations or not. Online-Shop.com.my will notify you of all amendments, changes, and alterations to this Agreement via written communication within 48 hours of the effective date of said change.
